Regulation
Enacted by virtue of section 9 of the Emergency
Decree on Public Administration of a State of Emergency,
B.E. 2548
(2005)

With
reference to the declaration of a state of emergency in all areas of the
Kingdom from 26th March B.E. 2563 (2020), and where such period of
enforcement has been continuously renewed;
In
order to prescribe necessary measures to stop the outbreak of a new wave of the
Coronavirus disease 2019 (COVID-19), which has spread in clusters in many different
areas of the country, especially in the areas under the highest level of
control in which it is necessary to issue strict measures to intercept and inhibit
the rapid spread of the disease, even though most of the population has continuously
cooperated with disease prevention measures throughout the occurrence; by
virtue of section 9 of the Emergency Decree on Public Administration of a State
of Emergency B.E. 2548 (2005) and section 11 of the State Administration Act,
B.E. 2534 (1991), the Prime Minister hereby issues this Regulation and Practice
to all government agencies as follows:
Clause
1. Elevation of disease prevention measures. Competent officials, communicable
disease control officers and persons responsible for an establishment,
activity, or any business shall ensure that users, travellers and members of
the public act strictly in accordance with disease prevention measures. This
being: maintaining social distance, wearing a fabric or surgical mask, washing
their hands, measuring body temperature, and installing prescribed
applications, as well as complying with self-quarantine measures according to
the period of time and in a designated place during the period of quarantine.
The
Government encourages the people to install and use the application “Mor Chana”
which has been jointly developed by the private and public sector, by the
Department of Disease Control and the Digital Government Development Agency
(Public Organisation) whereby the people will benefit from the notification of
information, advice or alerts to reduce the risk of infection, especially for a
person within an area designated as being under the highest level of control,
so that outbreak investigation and monitoring may be conducted expeditiously,
coupled with the use of the application “Thai Chana” for effectiveness in implementation.
Clause
2. Elevation of the area under the highest level of control in which it is
necessary for the prescription of very strict measures. Competent
officials shall examine and control the use of transportation routes or the use
of vehicles by members of the public who travel into and out of an area designated
as being under the highest level of control and under strict level of control,
in which there is a risk for further outbreak of the disease, including
Chantaburi, Chonburi, Trat, Rayong and Samut Sakorn, in order to expeditiously intercept
and inhibit the spread of the disease. There shall be established, checkpoints
or extraction points to strictly screen travel to and from such areas, and
persons living in such areas shall install and use the application “Mor Chana”.
A
person who wishes to travel out of an area designated as being under the
highest level of control and under strict level of control must give a reason for
the necessity of travel by displaying their national I.D. card or any other
relevant identification card together with a document certifying such necessity
as issued by a relevant competent official or an administrative official in the
area, except in the case of a person who is exempted, hereby, in accordance
with the regulation prescribed by the Center for COVID-19 Situation
Administration, Ministry of Interior.
Clause
3. The suppression and punishment of wrongdoers causing the spread of the
disease. The
Government has a clear and definitive intention in the suppression and
punishment of competent officials, Government officials, including any person
who is involved in the smuggling of foreign migrant labour without passing examination
measures, disease screening measures, and public health quarantine measures,
including the neglect or omission of duty, or the facilitation of, or
conspiracy to enable the operation of a gambling den in different areas, which
is the source of the outbreak of the disease in clusters, leading to severe
consequences. As such, orders and insistence has been made for commanding
officials to expeditiously investigate the issue to punish the wrongdoers under
legal procedures, together with the establishment of a committee to oversee and
monitor the implementation and proposal of measures to prevent the reoccurrence
of the situation.
The
Center for
the Resolution of the Security Emergency Situation,
security agencies, and responsible officials shall rigorously perform their
duties, shall watch and monitor to prevent illegal entry into the country, as
well as to prevent the assemblage of individuals to partake in illegal gambling
which is the source of this outbreak of disease, and shall take both
disciplinary and penal legal proceedings,
The
Government encourages participation by the public in monitoring. If any action
or inaction that is an illegal act which has the effect of causing a major
outbreak of the disease is observed, leads may be reported to the Prime
Minister via the Center for COVID-19 Situation Administration, Government House.
Clause
4. Penalties.
Any person who violates this regulation as enacted by virtue of Section 9 of
the Emergency Decree on Public Administration of a State of Emergency B.E. 2548
(2005) shall be guilty of an offence which may be subject to a penalty of
imprisonment of not more than two years, or a fine of not more than
forty-thousand baht, or both.
Any
person who is infected who deliberately conceals information relating to travel
or gives false information to a communicable disease control officer causing an
obstruction to the investigation of an outbreak that leads to the spread of the
disease may fall within the scope of a violation or a refusal to comply with an
order of a communicable disease control officer which is an offence under the
Communicable Diseases Act, B.E. 2558 (2015).
Hereby,
as from the 7th January, B.E. 2564 (2021) onwards.
